SOR/2016-169 Children's Sleepwear Regulations Standard
1. Scope of Application:
These regulations apply to the import, advertising, and sale of loose-fitting sleepwear and tight-fitting sleepwear.
2. Labels
Loose-fitting sleepwear treated with flame retardants must be permanently labeled with tags that clearly and legibly display:
(a) The words "flame retardant" in English and "ignifugeant" in French; and
(b) Care instructions in both English and French, specifically detailing the washing process to ensure that the sleepwear does not lose its flame retardancy due to exposure to certain agents or treatments.
3. Flame Retardancy Testing
3.1. Tight-fitting sleepwear must have a flame spread time exceeding 7 seconds when tested according to CGSB standard CAN/CGSB-4.2 No. 27.5 "Textile Test Methods: Flame Resistance - 45-Degree Angle Test - One-Second Flame Impingement."
3.2. Loose-fitting Sleepwear
3.2.1. Loose-fitting Sleepwear - Flame Retardancy Test
(1) When tested in accordance with Schedule 1, loose-fitting sleepwear must:
(a) Have an average char length of no more than 178 mm across five specimens; and
(b) Not have more than one specimen with a char length equal to the full length of the specimen.
3.2.2. Note: Loose-fitting Sleepwear - Other Tests
(2) Loose-fitting sleepwear treated with flame retardants, any components extracted or decomposed from such treated sleepwear, and any flame retardants used in the treatment must not result in any of the following:
(a) Acute lethality when tested for acute oral toxicity or acute dermal toxicity in accordance with Section 1 or 2 of Schedule 2, as applicable, at an oral dose of 500 mg/kg or less, or a dermal dose of 1000 mg/kg or less;
(b) An average score greater than 1 for erythema formation or edema formation measured at any specified time when tested for skin irritation in accordance with Section 3 of Schedule 2;
(c) A reaction in more than 15% of test animals when using the Draize test or Buehler test, or more than 30% when using one of the other five tests that include adjuvants, as specified in OECD Test No. 406 referenced in this section, when tested for skin sensitization in accordance with Section 4 of Schedule 2;
(d) Evidence of gene mutation or chromosomal aberration when tested for mutagenicity in accordance with Section 5 of Schedule 2; or
(e) Evidence of tumors when tested for tumorigenicity in accordance with Section 6 of Schedule 2.
